On June 11, 2019, the Poudre School District (PSD) Board of Education approved a Land Exchange Agreement, attached for Board reference, which outlined how and if PSD and HF2M Inc. would exchange property when the Montava Development proceeded. As part of the City of Fort Collins development process, HF2M Inc. is required to submit and finalize a Planned Unit Development (PUD) along with a PUD Master Plan Development Agreement (DA), both of which are attached for Board review and action. These documents outline how HF2M Inc. will address regional and local infrastructure improvements associated with the Montava development. The PUD and associated DA require PSD’s signature as the land PSD currently owns, commonly referred to as the Mountain Vista site, and the proposed future PSD middle school and high school sites are within the Montava PUD boundary. These agreements do not obligate PSD to fund any infrastructure improvements beyond what is typically required of PSD, nor do these agreements obligate PSD to fund anything at this time.
The property owner signature block section of the PUD and the PUD Master Plan Development Agreement have been reviewed by attorney Darryl Farrington with Semple, Farrington, Everall & Case, whom PSD frequently uses for matters concerning construction and real estate law.
